Aggregate Statistical Usage. Customer acknowledges and agrees that Xxxxx will collect data related to the performance of the Services for the purposes of aggregation and the creation of a centralized benchmarking mechanism. Notwithstanding anything to the contrary in this Agreement, Customer acknowledges and agrees that Maxim shall have a perpetual right to collect, use, and disclose the data collected relating to the Services and derived from Customer’s use of Maxim, Maxim Personnel, and Contractors affiliated with Maxim under this Agreement for the analysis, benchmarking, analytics, marketing, or other business purposes as long as all data collected is done in an anonymized aggregated manner, with Customer’s data aggregated with data of other Maxim customers, so as to be non-specific to any individual Customer.

Notwithstanding anything to the contrary in this Agreement, Customer acknowledges and agrees that BEAM, LLC shall have a perpetual right to collect, use, and disclose the data collected relating to the Services and derived from Customer’s use of BEAM, LLC, BEAM, LLC Personnel, and Contractors affiliated with BEAM, LLC under this Agreement for the analysis, benchmarking, analytics, marketing, or other business purposes as long as all data collected is done in an anonymized aggregated manner, with Customer’s data aggregated with data of other BEAM, LLC customers, so as to be non-specific to any individual Customer.

Customer acknowledges and agrees that MSP will collect data related to the performance of the Staffing Services for the purposes of aggregation and the creation of a centralized benchmarking mechanism. Customer acknowledges and agrees that MSP shall have the perpetual right to use and disclose the data collected relating to the Services, in any manner, as long as any data collected is done on an aggregate basis, with Customer’s data aggregated so as to be non-specific to Customer or including any personally identifiable information of an individual.
