Agreements with Carriers. MESA will endeavor in each case to enter into a written agreement with the carriers with whom it arranges to haul CUSTOMER’s freight, which, among other things, will define the roles and terms that MESA and such carrier will undertake with respect to such freight. CUSTOMER may request that MESA provide it with a copy of the form agreement that MESA typically enters into with carriers, although CUSTOMER must recognize that the terms of MESA’s agreements with carriers may vary from time-to-time.
Agreements with Carriers. TRIVERGIX will endeavor in each case to enter into a written agreement with the carriers with whom it arranges to haul CUSTOMER’s freight, which, among other things, will define the roles and terms that TRIVERGIX and such carrier will undertake with respect to such freight, provided that TRIVERGIX may from time to time enter into a different agreement CARRIER as TRIVERGIX determines to be appropriate in TRIVERGIX’s sole discretion. CUSTOMER may request that TRIVERGIX provide it with a copy of the form agreement that TRIVERGIX typically enters into with carriers.
