Agricultural Activities. Lessor reserves the right to initiate or continue irrigation and agricultural activities (including timbering) on the Leased Premises. If Lessor decides to conduct agricultural activities on the Leased Premises, Lessee will accommodate Lessor’s agricultural use to the extent practical in light of the rights granted to Lessee hereunder and the potential use of the property for the purposes set forth in the Lease.
Agricultural Activities. Unless currently used for agricultural or similarly related purposes, conversion of, or expansion into, any portion of the Conservation Area(s) for use of agricultural, horticultural, aquaculture, silviculture, livestock production or grazing activities. This prohibition also includes conversion from one type of these activities to another (e.g., from agriculture to silviculture). [NOTE: THE FOLLOWING LANGUAGE SHOULD BE ADDED, AS APPROPRIATE FOR PROJECTS IN DESIGNATED BOG TURTLE COUNTIES: Corps approved management practices, including the introduction of livestock, for the purpose of maintaining bog turtle habitat, are not included in this prohibition.];
Agricultural Activities. Agricultural Activities are: 1. allowed in the ADA with no restrictions; 2. prohibited within the FA except for wildlife feed-plots consistent with Section 4(K) 3. allowed in the MUA subject to the following conditions:
a. Agricultural Activities shall not occur on more than 20 acres of the MUA during the course of one calendar year, except as otherwise provided in Section 4(B)3(f).
b. Tilled or cultivated soil shall be revegetated as soon as practicable and shall not be exposed during winter months;
c. Grantor shall erect and maintain adequate fences so as to exclude livestock from Watercourses and Wetlands.
d. Grantor shall prevent the discharge of Waste or contaminated runoff from livestock into any Watercourse or Wetland.
e. Agricultural Activities that disturb soil are prohibited within 25 feet of a Watercourse or Wetland unless Grantor has obtained prior written approval of Grantee.
f. Brush hogging and haying may occur on more than 20 acres but is prohibited within 25 feet of a Watercourse or Wetland. Notwithstanding the aforesaid, brush hogging within 25 feet of a Watercourse or Wetland for the sole purpose of removing an invasive species is allowed with prior notice and written approval of the Grantee.
Agricultural Activities. The agricultural activities for each year will be agreed upon on the Annual Permit which when signed by the permittee, then becomes part of this agreement. It is understood that the Department is using agricultural agreements solely to further wildlife benefits on the project lands and that specified agricultural practices and conditions may differ from those common in the private sector.
Agricultural Activities. The right to conduct Agricultural Activities, provided that all agricultural structures shall be subject to the limitations of Paragraph
Agricultural Activities. Covered Activities for the agriculture and ranching sector include: • Brush management: Brush management may consist of using approved herbicide, mechanical, and prescribed burning practices to control or suppress shinnery oak in accordance with this CCAA, and mesquite and other brush in DSL Habitat if done in accordance with Conservation Measures described in the CCAA.
Agricultural Activities. In the construction and operation of its Windpower Facilities, Grantee will make commercially reasonable efforts not to interfere with Owner’s agricultural activities on the Property. To facilitate communication, Grantee and Owner will each designate a single point of contact with the other party.
Agricultural Activities. Subject to Section 8.2 below, Xxxxxxx’s operation of Windpower Facilities shall not unreasonably disturb Owner’s current agricultural use of the Property. Upon completion of construction, all Property disturbed by Grantee and not required for continuing operations of the Windpower Facilities, shall be restored to a condition reasonably similar to its original condition, consistent with the continued use of the Property pursuant to this Agreement. Reclamation shall include, as reasonably required, leveling, terracing, mulching and other reasonably necessary steps to prevent soil erosion. Included in the scope of reclamation activities shall be the repair, and when reasonably determined to be necessary, the replacement of underground drainage tile that was disturbed during the construction process. Grantee shall use commercially reasonable efforts to substantially replace removed topsoil to its general original location, with the exception of the Windpower Facilities’ foundations. Excavated soils shall be separated, such that the top soil remains separate from the subsoil. Except for de minimus amounts that are removed as a consequence of construction, topsoil shall not be removed from the Property without the consent of Owner.
Agricultural Activities. To conduct farming, ranching, and other agricultural activities, including raising and managing livestock and planting, raising, and harvesting agricultural crops.
Agricultural Activities. Xxxxxx agrees to conduct agricultural operations on the Leased Premises in a manner consistent with the multiple management objectives of the Park, described within the above-referenced Comprehensive Management Plan, for recreation and wildlife uses as well as for agriculture. Lessee’s agricultural activities and practices shall be consistent with the terms and provisions of the Governing Documents and will be planned collaboratively with the Oversight Committee. The management framework and specific implementation requirements for this lease are identified in Attachment A.
