Alternate Formal Presentation. When the grievance concerns a matter which is within the authority of the Xxxx and complains of affirmative conduct by the Xxxx (other than the Xxxx’x mere approval of any decision or action of others, including Chairpersons), the grievance may be presented as follows: 1. Prior to the presentation of the grievance, but within the twenty (20) school day period set forth above in Section a(1), the grieving faculty member shall meet and confer with the Xxxx (with or without union representation) to reach an amicable resolution, which resolution shall not be considered a “past practice” or other precedent; provided, however, that the faculty member is not entitled to a “hearing” as set forth in Section 21.06a below. 2. If no resolution is reached with the Xxxx, then the grievance may be presented to the Office of the Xxxxxxx. The grievance must be presented within five (5) school days after the meet and conferral with the Xxxx or twenty (20) school days following the faculty member’s knowledge of the act, event, or the commencement of the condition which is the basis of the grievance, whichever is later.
