Amendment Limited. Except as expressly provided herein, each of the provisions of the Agreement shall remain in full force and effect following the execution of this Amendment.
Amendment Limited. This Amendment shall not amend or modify the terms of the Agreement, except to the extent expressly set forth above, which Agreement, as amended hereby, shall remain in full force and effect.
Amendment Limited. Except as expressly provided in this Amendment, the SPA is not otherwise amended, modified or affected by this Amendment. The terms and conditions of the SPA, as amended by this Amendment, constitute the entire agreement and understanding of the parties hereto with respect to its subject matter and supersede all oral communications and prior writings with respect thereto.
Amendment Limited. Except as provided herein, each of the provisions of the Merger Agreement shall remain in full force and effect following the execution of this Amendment.
Amendment Limited. Except as provided for in this Amendment and except as may be required for consistency with this Amendment, the Lease remains unmodified and in full force and effect.
Amendment Limited. Except as provided herein, the provisions of the Option Agreement and the Plan shall remain in full force and effect and this Amendment shall not constitute a modification, acceptance or waiver of any other provision of the Option Agreement or the Plan. This Amendment shall be governed by and construed in accordance with the terms of the Plan.
Amendment Limited. All terms, provisions, covenants, representations, warranties, agreements and conditions contained in the Credit Agreement shall remain in full force and effect except as expressly contemplated herein and shall not otherwise be deemed waived, modified or amended hereby.
Amendment Limited. In all other respects, the Stock Repurchase Agreement is hereby ratified, confirmed and approved, and all terms thereof shall remain in full force and effect.
Amendment Limited. This Facility Increase Amendment is limited as specified herein and shall not constitute a modification, acceptance or waiver of any other provision of the Revolving Credit Agreement. The terms and conditions of the Revolving Credit Agreement, as amended by this Facility Increase Amendment, constitute the entire agreement and understanding of the parties hereto with respect to its subject matter and supersede all oral communications and prior writings with respect thereto.
Amendment Limited. Other than as set forth in this Amendment, all of the terms and conditions of the Purchase Agreement and Notes will continue in full force and effect.
