Amendment to Clause 3. 2: In sub-clause 3.2.4, after the word "Trustee" appearing for the first time, words "to Clause 37 of this Deed" be and are hereby omitted.
Amendment to Clause 3. 3: In sub-clause 3.3.1, the word "three" appearing for the second time before the word "months", be and is hereby replaced by "four".
Amendment to Clause 3. 1. Pursuant to this Amendment, the following sentence is hereby substituted for the first sentence of clause 3.1 of the Research and Licence Agreement: BIOVATION agrees to grant and hereby grants to MICROMET a non-exclusive, world-wide licence, with the right to grant sublicences, under the BIOVATION PATENT RIGHTS to make, have made, use, research, develop, sell, offer for sale, import, and export the DEIMMUNISED ANTIBODY (as specified in Schedule II), the DELIVERABLES, and/or the BISPECIFIC PRODUCTS in the FIELD.
Amendment to Clause 3. 4: The proviso to clause 3.4 of the Custodian Agreement, as previously amended on September 13, 2006 and February 8, 2010, is hereby further amended to read in its entirety as follows: “provided, that we will not be required to take any additional delivery of Silver if, after giving effect to such delivery, the aggregate amount of Bullion in the Account would exceed 500,000,000 txxx ounces.”
