Amendment to Section 6.15. Section 6.15 of the Credit Agreement is hereby restated in its entirety as follows:
Amendment to Section 6.15. Section 6.15 of the Credit Agreement is hereby amended by adding the text "other than December 31, provided that if any Borrower or any Subsidiary (other than the Subsidiary Non-Guarantors) changes the end of its fiscal year from September 30 to December 31, such Borrower or Subsidiary, as the case may be, may not at any time change the end of its fiscal year to any other date, including September 30" at the end of such Section.
Amendment to Section 6.15. Section 6.15 of the Agreement is hereby deleted and replaced in its entirety with the following:
Amendment to Section 6.15. The parties agree and acknowledge that any and all rights of Seller set forth in Section 6.15 of the Agreement are hereby extinguished and terminated; provided, that, the obligations of Seller and its representatives set forth in Section 6.15 shall continue.
Amendment to Section 6.15. Section 6.15 of the Existing Credit Agreement is hereby amended by adding the following text at the end of clause (b) thereof: “, except to the extent permitted under Section 5.8”.
Amendment to Section 6.15. Section 6.15(a) of the Credit Agreement is hereby amended by replacing the text “$20,000,000” in such Section with the text “(i) in the case of any such fiscal year commencing prior to the Amendment No. 1 Effective Date, $20,000,000 and (ii) in the case of any such fiscal year commencing on or after the Amendment No. 1 Effective Date, $12,500,000”.
Amendment to Section 6.15. A new Section 6.15 is hereby added to the end of Article VI of the Credit Agreement to read as follows:
Amendment to Section 6.15. Section 6.15 is hereby amended to delete therefrom the phrases: “and, if such contamination affects any Unencumbered Properties, would not cause a Pool Violation,” and “or, if related to any Unencumbered Properties, could result in a Pool Violation.”
