An Unclear Common Position: The Example of Mental Injury. (1) Preliminary Remarks Sometimes, the lack of common agreement leads to unfortunate situ- ations where, despite the will to achieve a uniform position, the Travaux Préparatoires report what could be considered a failure in the negotiations on specific points.
