Common use of Analog Outputs Clause in Contracts

Analog Outputs. If the licensed content can be delivered to a device which has analog outputs, the Content Protection System must ensure that the devices meet the analog output requirements listed in this section. The Content Protection System shall enable CGMS-A content protection technology on all analog outputs from end user devices. Licensee shall pay all royalties and other fees payable in connection with the implementation and/or activation of such content protection technology allocable to content provided pursuant to the Agreement. If the licensed content can be delivered to a device which has digital outputs, the Content Protection System must ensure that the devices meet the digital output requirements listed in this section. The Content Protection System shall prohibit digital output of decrypted protected content. Notwithstanding the foregoing, a digital signal may be output if it is protected and encrypted by High-Bandwidth Digital Copy Protection (“HDCP”) or Digital Transmission Copy Protection (“DTCP”). Defined terms used but not otherwise defined in this Digital Outputs Section shall have the meanings given them in the DTCP or HDCP license agreements, as applicable. A device that outputs decrypted protected content provided pursuant to the Agreement using DTCP shall: Deliver system renewability messages to the source function; Map the copy control information associated with the program; the copy control information shall be set to “copy never” in the corresponding encryption mode indicator and copy control information field of the descriptor; Map the analog protection system (“APS”) bits associated with the program to the APS field of the descriptor; Set the image_constraint_token field of the descriptor as authorized by the corresponding license administrator; Set the retention state field of the descriptor as authorized by the corresponding license administrator; Deliver system renewability messages from time to time obtained from the corresponding license administrator in a protected manner; and Perform such additional functions as may be required by Licensor to effectuate the appropriate content protection functions of these protected digital outputs. At such time as DTCP supports remote access set the remote access field of the descriptor to indicate that remote access is not permitted A device that outputs decrypted protected content provided pursuant to the Agreement using HDCP shall: If requested by Licensor, at such a time as mechanisms to support SRM’s are available, deliver a file associated with the protected content named “HDCP.SRM” and, if present, pass such file to the HDCP source function in the device as a System Renewability Message; and Verify that the HDCP Source Function is fully engaged and able to deliver the protected content in a protected form, which means: HDCP encryption is operational on such output, Processing of the System Renewability Message associated with the protected content, if any, has occurred as defined in the HDCP Specification, at such a time as mechanisms to support SRM’s are available, and There is no HDCP Display Device or Repeater on such output whose Key Selection Vector is in such System Renewability Message at such a time as mechanisms to support SRM’s are available. HDCP must be enabled on all uncompressed digital outputs (e.g. HDMI, Display Port), unless the customer’s system cannot support HDCP (e.g., the content would not be viewable on such customer’s system if HDCP were to be applied) Upscaling: Device may scale Included Programs in order to fill the screen of the applicable display; provided that Licensee’s marketing of the Device shall not state or imply to consumers that the quality of the display of any such upscaled content is substantially similar to a higher resolution to the Included Program’s original source profile (i.e. SD content cannot be represented as HD content).

Analog Outputs. If the licensed content Included Programs can be delivered to a device which has analog outputs, the Content Protection System must be designed to ensure that the devices meet the analog output requirements listed in this section. As contemplated in Section 1.4 of the Agreement, the requirements in this Section 1.3 shall apply with respect to all Flash Devices commencing October 31, 2010. For avoidance of doubt, inability of software or firmware used in the Content Protection System to trigger output protections implemented in physical outputs on a device doesn’t constitute an exemption to the requirements of this Section 1.3[; provided, however, that Licensor hereby agrees that Amazon shall be deemed to have met the requirements of this Section 1.3 with respect to Flash Devices if the Content Protection System utilizes the then-current WideVine conditional access and digital rights management solution for purposes of triggering such output protections][NOTE: IS THIS ALLOWANCE STILL NECESSARY?]. The Content Protection System shall enable Macrovision content protection technology on all analog outputs from end user devices. The Content Protection System shall enable CGMS-A content protection technology on all analog outputs from end user devices. Licensee Analog outputs at resolution greater then 1080i are prohibited. Analog outputs at 1080p are prohibited. Licensor shall pay all royalties and other any per-transaction license fees payable in connection with the for implementation and/or activation of such content protection technology allocable required under this Section 1.3. Amazon shall pay any fees for implementation of content protection technology required under this Section 1.3 other than per-transaction license fees. Amazon shall have no obligation to enable content provided pursuant to protection technology required under this Section 1.3 if doing so would materially degrade customer viewing of the AgreementIncluded Program on a Flash Device or Hardware-Based DRM Streaming Device. Digital Outputs. If the licensed content Included Programs can be delivered to a device which has digital outputs, the Content Protection System must be designed to ensure that the devices meet the digital output requirements listed in this section. As contemplated in Section 1.4 of the Agreement, the requirements in this Section 1.4 shall apply with respect to all Flash Devices commencing October 31, 2010 (or commencing on any later dates to which Licensor agrees in its sole discretion in writing). For avoidance of doubt, inability of software or firmware used in the Content Protection System to trigger output protections implemented in physical outputs on a device doesn’t constitute an exemption to the requirements of this Section 1.4. The Content Protection System shall prohibit digital output of decrypted protected content. Notwithstanding the foregoing, a digital signal may be output if it is protected and encrypted by High-Bandwidth Digital High Definition Copy Protection (“HDCP”) or Digital Transmission Copy Protection (“DTCP”). Defined terms used but not otherwise defined in this Digital Outputs Section 1.4.1 shall have the meanings given them in the DTCP or HDCP license agreements, as applicable. A device that outputs decrypted protected content provided pursuant to the Agreement using DTCP shall: Deliver system renewability messages to the source function; Map the copy control information associated with the program; the copy control information shall be set to “copy never” in the corresponding encryption mode indicator and copy control information field of the descriptor; Map the analog protection system (“APS”) bits associated with the program to the APS field of the descriptor; Set the image_constraint_token field of the descriptor as authorized by the corresponding license administrator; Set the eligible non-conditional access delivery field of the descriptor as authorized by the corresponding license administrator; Set the retention state field of the descriptor as authorized by the corresponding license administrator; Deliver system renewability messages from time to time obtained from the corresponding license administrator in a protected manner; and Perform such additional functions as may be required by Licensor to effectuate the appropriate content protection functions of these protected digital outputs. At For Xxxxxx Xxxxxxx, BIVL revocation mechanisms shall be used to revocate any devices revoked in HDCP SRM messages. For Hardware-Based DRM Streaming Devices required to support HDCP SRM messages by their HDCP license agreement, Amazon will work in good faith to implement a delivery mechanism for such time as DTCP supports remote access set the remote access field of the descriptor to indicate that remote access is not permitted A device that outputs decrypted protected content provided pursuant to the Agreement using HDCP shallSRM messages when such a mechanism becomes available that: If requested by Licensor, at such a time as mechanisms to support SRM’s are available, deliver delivers a file associated with the protected content named “HDCP.SRM” and, if present, pass passes such file to the HDCP source function in the device as a System Renewability Message; and Verify Verifies that the HDCP Source Function is fully engaged and able to deliver the protected content in a protected form, which means: HDCP encryption is operational on such output, Processing of the System Renewability Message associated with the protected content, if any, has occurred as defined in the HDCP Specification, at such a time as mechanisms to support SRM’s are available, and There is no HDCP Display Device or Repeater on such output whose Key Selection Vector is in such System Renewability Message at such a time as mechanisms Message. The Content Protection System shall prohibit recording of protected content onto recordable or removable media. Licensor shall pay any per-transaction license fees for implementation of content protection technology required under this Section 1.4. Amazon shall pay any fees for implementation of content protection technology required under this Section 1.4 other than per-transaction license fees. Amazon shall have no obligation to support SRM’s are availableenable content protection technology required under this Section 1.4 if doing so would materially degrade customer viewing of the Included Program on the Flash Device or Hardware-Based DRM Streaming Device. HDCP must be enabled on all Outputs Analog Outputs. ADSI shall signal for CGMS-A set to “Copy Never” to be activated if the Authorized Device has analog outputs that are not disabled. Digital Outputs. ADSI shall signal for the following digital video output copy protections to be activated: HDCP if the Authorized Device has uncompressed digital video outputs (e.g. HDMI, Display Port), Port),that are not disabled unless the customercustomer’sSubscriber’s system cannot support HDCP (e.g., the content contentSubscription Title would not be viewable on such customercustomer’sSubscriber’s system if HDCP were to be applied) Upscalingapplied).activated); and [From Xxx: Device may scale Included Programs this allowance for non-support of HDCP only applies to SD and does not apply to HD. If HD is in order to fill the screen of the applicable display; provided that Licensee’s marketing of the Device shall not state or imply to consumers that the quality of the display of any such upscaled content is substantially similar to a higher resolution scope here, we need quickly agree some language for HD to the Included Program’s original source profile (i.e. SD content cannot be represented as HD content)PC that we are working on based on the iTunes agreement.]
