Common use of Ancillary Obligations Clause in Contracts

Ancillary Obligations. This covenant shall be construed as an obligation ancillary to the other provisions of this Agreement and the existence of any claim or cause of action by the Partners, or any one of them, whether predicated on a breach of this Agreement or of the Ancillary Agreements or otherwise, shall not constitute a defense to the enforcement by PHC, Purchasers or any party to the Ancillary Agreements of this covenant.
