Anticipatory Demolition. As stated in H 190 Part 601.27.A(2), NRCS Utah will not provide technical or financial assistance to Cooperators who intentionally destroy, remove, or otherwise adversely affect historic properties within a conservation planning area in an effort to evade compliance with Section 106 of the NHPA. If such damages occur, NRCS Utah shall insure that Federal assistance is not used to cause or further an adverse impact to a cultural resource. Under these circumstances, NRCS will follow its Procedures for the Withdrawal of Assistance found in GM 420 Part 401.23 and H 190 Part 601.27.
