Common use of Appearance as Witness Clause in Contracts

Appearance as Witness. Notwithstanding any other provision of this Article 9, the Company may pay or reimburse expenses incurred by a Managing Member (or owner, employee or agent thereof), a member of the Advisory Board or any agent or employee of the Company in connection with its appearance as a witness or other participation in a Proceeding at a time when it is not a named defendant or respondent in the Proceeding.

Appearance as Witness. Notwithstanding any other provision of this Article 98, the Company may pay or reimburse expenses incurred by a Managing Member (or owner, employee or agent thereof), a member of the Advisory Board or any agent or employee of the Company Manager in connection with its his or her appearance as a witness or other participation in a Proceeding at a time when it he or she is not a named defendant or respondent in the Proceeding.

Appearance as Witness. Notwithstanding any other provision of this Article 9VII, the Company may pay or reimburse expenses incurred by a Managing Member (or owner, employee or agent thereof), a member of the Advisory Board or any agent or employee of the Company Manager in connection with its his appearance as a witness or other participation in a Proceeding at a time when it he is not a named defendant or respondent in the Proceeding.

Appearance as Witness. Notwithstanding any other provision of this Article 9Section 6.9, the Company may shall pay or reimburse reasonable out-of-pocket expenses incurred by a Managing Member (Manager or owner, employee or agent thereof), a member of the Advisory Board or any agent or employee of the Company Officer in connection with its his appearance as a witness or other participation in a Proceeding at a time when it he is not a named defendant or respondent in the Proceeding.

Appearance as Witness. Notwithstanding any other provision of this Article 97, the Company may pay or reimburse expenses incurred by a Member or Managing Member (or owner, employee or agent thereof), a member of the Advisory Board or any agent or employee of the Company in connection with its appearance as a witness or other participation in a Proceeding at a time when it is not a named defendant or respondent in the Proceeding.
