Common use of Application by Fiscal Agent Clause in Contracts

Application by Fiscal Agent. The Fiscal Agent shall apply each amount paid to it hereunder in accordance with Clause 8 (Payments to Noteholders) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void under Condition 14 (Prescription) or otherwise ceases in accordance with the Conditions, in which event it shall refund at the written request of the Issuer such portion of such amount as relates to such payment by paying the same by credit transfer to such account with such bank as the Issuer has by notice to the Fiscal Agent specified for the purpose.

Application by Fiscal Agent. The Fiscal Agent shall apply each amount paid to it hereunder in accordance with Clause 8 7 (Payments to NoteholdersHolders of Securities) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void under Condition 14 10 (Prescription) or otherwise ceases in accordance with the Conditions), in which event it shall as soon as practicable refund at the written request of the Issuer such portion of such amount as relates to such payment by paying the same by credit transfer in euro to such account with such bank as the Issuer or (as the case may be) the Guarantor has by notice to the Fiscal Agent specified for the purpose.

Application by Fiscal Agent. The Fiscal Agent shall apply each amount paid to it hereunder in accordance with Clause 8 (Payments to Noteholders) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void under Condition 14 15 (Prescription) or otherwise ceases in accordance with the Conditions, in which event it shall refund at the written request of the Issuer such portion of such amount as relates to such payment by paying the same by credit transfer to such account with such bank as the Issuer has by notice to the Fiscal Agent specified for the purpose.

The Fiscal Agent shall apply each amount paid to it hereunder under this Clause 6 (Payments to the Fiscal Agent) in accordance with Clause 8 7 (Payments to Noteholders) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void under Condition 14 9 (Prescription) or otherwise ceases in accordance with the Conditions), in which event it shall refund at the written request of the Issuer such portion of such amount as relates to such payment by paying the same by credit transfer in Euros to such account with such bank as the Issuer has by notice to the Fiscal Agent specified for the purpose.

The Fiscal Agent shall apply each amount paid to it hereunder in accordance with Clause 8 9 (Payments to Noteholders) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void under Condition 14 12 (Prescription) or otherwise ceases in accordance with the Conditions, in which event it shall refund at the written request of the Issuer or (as the case may be) the Guarantors such portion of such amount as relates to such payment by paying the same by credit transfer to such account with such bank as the Issuer or (as the case may be) the Guarantors has by notice to the Fiscal Agent specified for the purpose.

The Fiscal Agent shall apply each amount paid to it hereunder under this Clause 6 (Payments to the Fiscal Agent) in accordance with Clause 8 7 (Payments to Noteholders) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void under Condition 14 8 (Prescription) or otherwise it ceases in accordance with the Conditions, in which event it shall refund at the written request of the Issuer such portion of such amount as relates to such payment by paying the same by credit transfer in EUR to such account with such bank as the Issuer has by notice to the Fiscal Agent specified for the purpose.

No money held by any of the Paying Agents needs to be segregated except as required by law.

The Fiscal Agent shall apply each amount paid to it hereunder under this Clause 7 (Payments to the Fiscal Agent) in accordance with Clause 8 (Payments to Noteholders) and shall not be obliged to repay any such amount unless the claim for the relevant payment becomes void under Condition 14 9 (Prescription) or otherwise ceases in accordance with the Conditions), in which event it shall refund at the written request of the Issuer such portion of such amount as relates to such payment by paying the same by credit transfer in USD to such account with such bank in New York as the Issuer has by notice to the Fiscal Agent specified for the purpose.

The Fiscal Agent shall apply each amount paid to it hereunder under this Clause 7 in accordance with Clause 8 (Payments to Noteholders) and shall not be obliged or entitled to repay any such amount unless the claim for the relevant payment becomes void under Condition 14 9 (Prescription) or otherwise ceases in accordance with the Conditions), in which event it shall refund at the written request of the Issuer such portion of such amount as relates to such payment by paying the same by credit transfer in euro to such account with such bank as the Issuer has by notice to the Fiscal Agent specified for the purpose.
