APPLICATION OF AGREEMENT AND PARTIES COVERED. 4.1 This Agreement applies to and covers: (a) the State of Victoria in respect of all Employees (as defined in clause 2); (b) all Employees whose employment is, at any time when this Agreement is in operation, subject to this Agreement; and (c) the CPSU. 4.2 In accordance with Part 2-8 of the FW Act, where there is a transfer of business to a new employer, the new employer is bound by this Agreement as a transferable instrument to the extent that it relates to the whole or part of the business transfer. 4.3 Agency-specific arrangements
