Common use of Application of Laws Clause in Contracts

Application of Laws. This Agreement is not intended to limit the obligations imposed on Contractor under applicable laws, rules and regulations, including, at a minimum, the Affordable Care Act, the California Affordable Care Act, and applicable State regulatory requirements, in existence as of the date of this Agreement or as may be enacted or modified during the term of this Agreement. The failure to reference a regulatory requirement in this Agreement does not affect the applicability of such requirement to Contractor and the Exchange. Subject to the requirements set forth in 12.14, in those instances where the Exchange has affirmatively elected to impose a requirement authorized by the Exchange in accordance with the California Affordable Care Act that exceeds a lesser threshold that may be applicable under the Affordable Care Act or other Federal law, the State law shall be deemed controlling unless otherwise required under applicable laws, rules and regulations.
