Application to Dependent Care. This subsection E concerning cost changes applies in the case of a Dependent Care Assistance plan, if such a Benefit is provided under the Plan, only if the cost change is imposed by a dependent care provider who is not a relative of the employee, as described in Section 152(a)(1) through (8) of the Code, incorporating the rules of Section 152(b)(1) and (2) of the Code.
