Common use of Appointment and Obligations of the Remarketing Agent Clause in Contracts

Appointment and Obligations of the Remarketing Agent. (a) The Company hereby appoints Xxxxxx Brothers Inc. as exclusive remarketing agent (the "Remarketing Agent"), and Xxxxxx Brothers Inc. hereby accepts appointment as Remarketing Agent, for the purpose of (1) Remarketing Remarketed Senior Notes on behalf of the holders thereof and (2) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with and pursuant to the Remarketing Procedures.

Appointment and Obligations of the Remarketing Agent. (a) The Company and the Trust (together, the "ISSUERS") hereby appoints appoint Xxxxxx Brothers Inc. as exclusive remarketing agent (the "Remarketing AgentREMARKETING AGENT"), and Xxxxxx Brothers Inc. hereby accepts appointment as Remarketing Agent, for the purpose of (1i) remarketing the Remarketing Remarketed Senior Notes Securities on behalf of the holders thereof and (2ii) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with and pursuant to the Remarketing Procedures.

Appointment and Obligations of the Remarketing Agent. (a) The Trust and the Company hereby appoints appoint Xxxxxx Brothers Inc. Inc., as exclusive remarketing agent (the "Remarketing Agent"), and Xxxxxx Brothers Inc. hereby accepts appointment as Remarketing Agent, for the purpose of (1i) Remarketing remarketing Remarketed Senior Notes Securities on behalf of the holders thereof and (2ii) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with and pursuant to the Remarketing Procedures.

(a) The Company hereby appoints Xxxxxx Brothers Inc. as exclusive remarketing agent (in such capacity, the "Remarketing Agent"), and Xxxxxx Brothers Inc. hereby accepts appointment as Remarketing Agent, for the purpose of (1i) Remarketing Remarketed Senior Notes Perpetual Preference Shares on behalf of the holders thereof and (2ii) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with and pursuant to the Remarketing Procedures.

(a) The Company and the Trust (together, the "Issuers") hereby appoints appoint Xxxxxx Brothers Inc. as exclusive remarketing agent (the "Remarketing Agent"), and Xxxxxx Brothers Inc. hereby accepts appointment as Remarketing Agent, for the purpose of (1i) Remarketing Remarketed Senior Notes Securities on behalf of the holders thereof and (2ii) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with and pursuant to the Remarketing Procedures.

(a) The Company Company, Capital Markets and the Trust (collectively, the "Issuers") hereby appoints appoint Xxxxxx Brothers Inc. as exclusive remarketing agent (the "Remarketing Agent"), and Xxxxxx Brothers Inc. hereby accepts appointment as Remarketing Agent, Agent for the purpose of (1i) Remarketing Remarketed Senior Notes Securities on behalf of the holders thereof and (2ii) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with and pursuant to the Remarketing Procedures.
