Common use of Appointment and Obligations of the Remarketing Agent Clause in Contracts

Appointment and Obligations of the Remarketing Agent. (a) The Company hereby appoints as exclusive ------------------------- remarketing agent (the "Remarketing Agent"), and ------------------------- hereby accepts appointment as Remarketing Agent, for the purpose of (1) Remarketing the Remarketing Senior Notes on behalf of the holders thereof and (2) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with the Remarketing Procedures.

Appointment and Obligations of the Remarketing Agent. (a) The Company hereby appoints Xxxxxx Xxxxxxx & Co. Incorporated as exclusive ------------------------- remarketing agent (the "Remarketing Agent"), and ------------------------- Xxxxxx Xxxxxxx & Co. Incorporated hereby accepts appointment as Remarketing Agent, for the purpose of (1) Remarketing the Remarketing Remarketed Senior Deferrable Notes on behalf of the holders thereof and (2) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with and pursuant to the Remarketing Procedures.

Incorporated hereby accepts appointment as Remarketing Agent, for the purpose of (1) Remarketing the Remarketing Senior Notes Remarketed Preferred Shares on behalf of the holders thereof and (2) performing such other duties as are assigned to the Remarketing Agent in the Remarketing Procedures, all in accordance with and pursuant to the Remarketing Procedures.

Appointment and Obligations of the Remarketing Agent. Appointment and Obligations of the Remarketing Agent.
