Common use of Appraisal Contingency Clause in Contracts

Appraisal Contingency. Xxxxx’s obligation to purchase the property is contingent upon the property 14 appraising for not less than the Purchase Price. If after the completion of an appraisal by a licensed appraiser, Xxxxx receives written 15 notice from the lender or the appraiser that the Property has appraised for less than the purchase price (a “Notice of Appraised Value”) 16 Buyer may attempt to renegotiate or cancel this Agreement by providing written notice to the Seller (with a copy of the Appraisal) 17 no later than calendar days following the date of Acceptance of this Agreement; whereupon the EMD shall be released to the 18 Buyer without the requirement of written authorization from Seller.
