Arbitration Rules and Fees. Except as otherwise provided herein, the arbitration shall be conducted in accordance with the rules and procedures of the chosen arbitration forum in effect at the time of Xxxxxxxx’s execution of this Agreement. If JAMS is chosen, those rules shall be JAMS Comprehensive Arbitration Rules and Procedures; if ADR is chosen, those rules shall be the ADR Arbitration Rules. Those rules shall be referred to hereafter individually and collectively as the “ Rules”. The Rules shall apply regardless of the amount of the claims or cross claims in the proceeding. Discovery may be taken by the parties only in the manner prescribed by the Rules. In the discretion of the arbitrator(s), pre-arbitration conferences and hearings may be telephonic.
