Acknowledgment of Risk. The Client expressly acknowledges and agrees that the use of electronic communication systems to convey Instructions does not eliminate the risk of error and fraudulent activities or security and privacy issues.

Acknowledgment of Risk. I recognize and appreciate the dangers, hazards, and risks associated with participation in the camp activities. I understand that the dangers, hazards, and risks of the camp activities could include serious or even fatal injuries and property damage. I acknowledge that I have fully considered the dangers, hazards, and risks associated with my/Camper’s participation in the camp activities, and voluntarily assume those dangers, hazards, and risks. I give my consent and approval for my/Camper’s participation in the camp activities.
Acknowledgment of Risk. I understand and acknowledge that I voluntarily engage in the Course as a participant and, therewith, accept all risks, known and unanticipated, which could result in my injury, death, illness, disease, physical or mental, or damage to myself, to my personal property or to third parties. I understand and acknowledge that those risks may result in personal claims against Ah Haa or claims against me by third parties. Among these risks are the following: (1) the nature of the Course, whether it involves making use of heavy, potentially dangerous equipment or tools, and even if it is undertaken in a remote or wilderness area; (2) the effects of physical activity at high altitudes; (3) exposure to sun or other extreme weather conditions; (4) the acts or omissions, by the Ah Haa in any degree (including negligence); (5) acts of other persons and/or participants in the Course, including Ah Haa; (6) contact with plants or animals; (7) my own physical condition, and/or my own acts or omissions; (8) conditions of roads, trails, or terrain, and accidents connected therewith; (9) first-aid, emergency treatment or other services rendered; (10) consumption of food or drink; and/or (11) leaving Ah Haa property to go on the river trail, playground or field trips within the Town of Telluride and/or surrounding areas. I understand and acknowledge that the consequences of such hazards may be exacerbated due to occurrences in remote places where rescue and/or medical attention may not be readily available. I also understand and acknowledge that the consequences of occurrence of illness in such remote places likewise could be exacerbated. I understand and acknowledge that the above list is not complete or exhaustive, or intended to be, and that other risks, known and/or unknown, identified and/or unidentified, anticipated and/or unanticipated also may result in injury, death, illness, disease, or damage to myself, to my property and/or to other third parties with that understanding and acknowledgement, I still expressly accept those risks not specifically listed above, as well as those elaborated.

Acknowledgment of Risk. (i) The Purchaser acknowledges and understands that its investment in the Note and Conversion Shares involves a significant degree of risk, including, without limitation, (A) an investment in the Debtor is speculative, and only Purchasers who can afford the loss of their entire investment should consider investing in the Debtor and the Note and Conversion Shares; (B) the Purchaser may not be able to liquidate its investment; (C) transferability of the Note and Conversion Shares may be limited; (v) in the event of a disposition of this Note or the Conversion Shares, the Purchaser could sustain the loss of its entire investment; and (D) the Debtor has not paid any dividends on its Common Stock since inception and does not anticipate the payment of dividends in the foreseeable future; and (ii) The Purchaser is able to bear the economic risk of holding this Note and the Conversion Shares for an indefinite period, and has knowledge and experience in financial and business matters such that it is capable of evaluating the risks of the investment in the Note and the Conversion Shares.

Acknowledgment of Risk. I acknowledge that my participation at this facility and in the activities in which I am about to partake is voluntary and that such participation entails significant elements of risk, including unanticipated risks which could result in physical or emotional injury, paralysis, death or damage to myself, to property or to third parties. I understand that this can result in accidents and/or illness, including, but not limited to: Cuts, scrapes, wounds, abrasions, rope burn and or contusions; sprains, torn muscles and/or ligaments; fractured or broken bones; eye damage, dehydration, oxygen shortage, sickness; head and/or spinal injuries; insect bites; allergic reactions; shock, paralysis and/or death. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of these activities. I also understand that I can cease exposure to such risks by choosing not to partake in the activities or by otherwise withdrawing from such activities at any time. I acknowledge that the guides, instructors and facilitators have difficult jobs to perform and that although they seek safety, they are not infallible. I am aware that they may give inadequate warning or instruction and that the inherent and other risks of the activities that I am about to perform may be increased by my own fitness or ability levels, by weather or other environmental conditions, by equipment malfunction, structural failure and other unforeseen factors that may affect my overall safety. Activities will take place in a public setting, in which those coordinating the activity will, in many cases, not have control over the environment or surroundings. The risk of injury from the activities involved in these sport events is significant, including the potential for permanent paralysis and death, concussion, possible broken bones along with minor scrapes and bruises, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for my participation; and I willingly agree to comply with the stated instructions and policies and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official/coach/supervisor immediately; and I understand, agree and acknowledge that some activities may be of a hazardous nature and/or include physical and/or strenuous activity. Understanding this, I state that I have no medical condition or impairment that might inhibit my safe and active participation in the above listed activity. Acknowledgment of Risk. 9.1 The Client acknowledges and accepts that: (1) The Financial Instruments or funds of the Client may be held by a third party on behalf of the IF and in such cases the Client may not be fully protected against the insolvency of the third party or in case of any act or omission of any such third party. (2) The funds or Financial Instruments of the Client may be held in an omnibus account by a third party and in such cases the Client may not be fully protected against the insolvency of the third party or in case of any act or omission of any such third party. (3) The Financial Instruments may be held with a third party and such Financial Instruments may not be separately identifiable from the proprietary Financial Instruments of that third party or of the IF and in such cases the Client may not be fully protected against the insolvency of the third party or in case of any act or omission of any such third party. (4) The accounts that contain Financial Instruments or funds belonging to the Client may be subject to the law of a jurisdiction other than that of an EU member state and the rights of the Client relating to those Financial Instruments or funds may differ accordingly. (5) A depository may have a security interest or lien over, or right of set-off in relation to Financial Instruments or funds belonging to the Client. (6) Notwithstanding any Investment Advice or information which may have been given by the IF, the value of any investment in Financial Instruments may fluctuate either upwards or downwards. (7) The existence of a substantial risk of incurring losses and damages as a result of the purchase or sale of any Financial Instrument and acknowledges his willingness to take such risk. (8) When a Financial Instrument is negotiated in a currency other than the currency of the country of residence of the Client, any changes in the exchange rates may have a negative effect on its value. (9) Any Financial Instrument in foreign markets may entail risks different than the ordinary risks in the market at the Client’s country of residence. (10) Investments might be based on unrated securities, which bear significant credit and exchange rate risk. While the IF may attempt to put in place actual or synthetic hedging arrangements to address such risks, there can be no assurances that such hedging arrangements shall be available or that the hedging will be effective.
