Common use of Arbitrator’s determination Clause in Contracts

Arbitrator’s determination. If the parties are unable to resolve the dispute by the exchange of Notices or conference with the Independent Person and both parties agree, then they may require the dispute to be submitted to and settled by an arbitrator. Each party may make submissions to the arbitrator. The decision of the arbitrator will be final and binding on the parties. The arbitrator must also determine which party or parties pays the costs of and incidental to the resolution of the dispute. The arbitrator will be subject to the provisions of the Commercial Arbitration Act Queensland.
