Assignment by Department. Department may transfer or assign all or part of the Project Site(s) to another party. Upon and after such a transfer or assignment all obligations and liabilities of the Department shall terminate and such obligations and liabilities shall be the responsibility of the transferee or assignee to the extent of the Project Site(s) being transferred or assigned, except such as may have arisen from a breach by Department of any terms, covenants or conditions of the Contract during the period that the Department was the owner of and in possession of the Project Site(s).
Assignment by Department. Department may transfer and assign its rights, title and interests in the Agreement, this Lease and other Contract Documents as provided in Section 23.3 of the Agreement.
