STANDARDS OF COMFORT. QESP will maintain and operate the Equipment in a manner which will provide the standards of heating, cooling, ventilation, hot water supply, and lighting quality and levels as described in Schedule U (Standards of Comfort). During the term of this SOW, QESP and Department will maintain, respectively according to Schedule BB (QESP’s Maintenance Responsibilities) and Schedule CC (Department’s Maintenance Responsibilities), and operate the Equipment in a manner that will provide the standards of comfort and levels of operation as described in Schedule U (Standards of Comfort).
STANDARDS OF COMFORT. CONTRACTOR shall perform the Services in a manner that shall provide the standards of heating, cooling, hot water, lighting and other systems as set forth in the BOD (Standards of Comfort). Unless otherwise specified in the BOD, the Standards of Comfort shall include the provision of heat of neither less than 55 degrees Fahrenheit nor more than 75 degrees Fahrenheit. If at any time during the Contract Term the Standards of Comfort are not being met by the New Equipment/Systems, CONTRACTOR shall commence the correction of such deficiencies within seven (7) days of receipt of DCAMM’s written request to do so and shall complete the correction work within thirty (30) days from the date of receipt of such notice, unless it is an emergency under Section 29.4: Emergency, in which case the terms of Section 29.4: Emergency shall control. If changes in the operation of the New Equipment/Systems are warranted to achieve the required Standards of Comfort then adjustments shall be reflected in the M&V calculations set forth in the M&V plan developed in accordance with Section 21.3: Design Deliverables and Submittals. Failure to make the corrections required to achieve the Standards of Comfort or give written notice to DCAMM regarding the cause of the deficiencies in accordance with the time provided herein may constitute an event of default hereunder. To the extent that CONTRACTOR claims that such change in the Standards of Comfort is the result of the acts or omissions of DCAMM or other third party beyond CONTRACTOR’s reasonable control, CONTRACTOR shall give written notice to DCAMM within the seven (7) days provided above. Disputes related to deviations from the required Standards of Comfort shall be resolved in accordance with Section 52: Dispute Resolution of the Contract.
STANDARDS OF COMFORT. Contractor shall maintain and operate the Equipment in a manner which will provide the standards of heating, cooling, ventilation, hot water supply, and lighting quality and levels as described in Schedule U (Standards of Comfort). During the term of this Contract, Contractor and Agency will maintain, according to Schedule BB (Contractor’s Maintenance Responsibilities) and Schedule CC (Agency’s Maintenance Responsibilities), and operate the Equipment in a manner that will provide the standards of comfort and levels of operation as described in Schedule U (Standards of Comfort).
STANDARDS OF COMFORT. ESCO will maintain the current standards of comfort and those described in Exhibit D in areas where the ESCO is performing work on the applicable equipment. The equipment is being maintained by the owner and the owner agrees to operate the Equipment in a manner which will provide the standards of heating, cooling, hot water, and lighting as described in Exhibit C.

STANDARDS OF COMFORT. The University shall be responsible for maintaining the levels of comfort and service for each building as set forth in Schedule I after substantial completion. During construction however, ESCO and University shall coordinate equipment operation to maintain standards of comfort in spaces deemed critical by the University and defined as those spaces that cannot tolerate a large or prolonged deviation from the standards of comfort. Examples of critical spaces are research laboratories in which there are active experiments, animal labs, and laser labs. When standards of comfort cannot be maintained in critical spaces while the main equipment is shut down, ESCO shall provide other means to maintain standards of comfort.
STANDARDS OF COMFORT. ESCO will maintain and operate the Selected ECMs in a manner that will provide the standards of heating, cooling, hot water, and lighting as described in Schedule L (Standards of Comfort). During the Guarantee Period, ESCO and the School District will maintain, according to Schedule Q (ESCO’s ECM Service Responsibilities) and Schedule R (School District’s ECM Service Responsibilities), and operate the Selected ECMs in a manner that will provide the standards of comfort and levels of operation as described in Schedule L (Standards of Comfort).
STANDARDS OF COMFORT. RES shall not require the Customer to maintain and operate the Equipment in a manner which will result in compromising the accepted standards of heating, cooling, hot water, and lighting as described in Schedule I, during occupied hours of operation.
STANDARDS OF COMFORT. The standards of comfort to be maintained for heating, cooling, lighting levels, hot water temperatures, humidity levels and/or any special conditions for occupied and unoccupied areas of the facility should be explicitly described in this schedule. A complete description of the Contractor's specific operations and maintenance responsibilities should be included in this schedule along with the time intervals for their performance of the stated O&M activities (through Acceptance, through Performance Term, etc.). This schedule describes the operations and maintenance responsibilities that may be assigned to facility staff as agreed to by both parties. In some instances it will contain no more than a description of routine O&M currently being performed on existing energy consuming equipment in the facility. In other cases, facility staff may be used to provide some maintenance on the new equipment installed under the performance contract, with the Contractor providing any specialized services as needed.
