Assignment of Antitrust Rights. 12.1 Contractor irrevocably assigns to State any claim for relief or cause of action which Contractor now has or which may accrue to Contractor in the future by reason of any violation of 15 U.S.C. § 1-15 or ORS 646.725 or ORS 646.730, in connection with any Goods provided to Contractor for the purpose of carrying out Contractor’s obligations under this Contract, including, at State’s option, the right to control any such litigation on such claim for relief or cause of action. 12.2 Contractor shall require any subcontractors hired to perform any of Contractor’s duties under this Contract to irrevocably assign to State, as third party beneficiary, any right, title or interest that has accrued or which may accrue in the future by reason of any violation of 15 U.S.C. § 1-15 or ORS 646.725 or ORS 646.730, in connection with any Goods provided to the subcontractor for the purpose of carrying out the subcontractor’s obligations to Contractor in pursuance of this Contract, including, at State’s option, the right to control any such litigation on such claim for relief or cause of action.
