Common use of Assignment of Antitrust Rights Clause in Contracts

Assignment of Antitrust Rights. IT HVAR irrevocably assigns to the State Of Oregon any claim for relief or cause of action which the IT HVAR now has or which may accrue to the IT HVAR in the future by reason of any violation of 15 U.S.C. § 1-15 or ORS 646.725 or ORS 646.730, in connection with any goods or services provided to the IT HVAR for the purpose of carrying out the IT HVAR's obligations under this Agreement or any Contract, including, at the State's option, the right to control any such litigation on such claim or relief or cause of action. IT HVAR shall require any subcontractors hired to perform any of IT HVAR's duties under this Agreement or any Contract to irrevocably assign to the State of Oregon, as third party beneficiary, any right, title or interest that has accrued or which may accrue in the future by reason of any violation of 15 U.S.C. § 1-15 or ORS 646.725 or ORS 646.730, in connection with any goods or services provided to the subcontractor for the purpose of carrying out the subcontractor's obligations to the IT HVAR in pursuance of this Agreement or any Contract, including, at the State's option, the right to control any such litigation on such claim or relief or cause of action.
