Assistance with Misapplied Funds. Without limiting the other responsibilities of the Subscriber, where the Subscriber is notified by another Participating Subscriber, or by XXXX, that an excess or incorrect payment has been made or received in connection with a Scheduled Settlement, the Representative Subscriber, where it receives such a notice, must take such action as is reasonable in the circumstances to assist with the rectification or limitation of any notified mistake that has occurred, but only: (a) to the extent that there is an appropriate and reasonable step to be taken by the Subscriber, as determined in its sole and absolute discretion; and (b) where that Subscriber has the right or power to take the particular step or action.
