Audit By Secretary of HHS. Business Associate will make its internal practices, books, and records relating to the use and disclosure of Protected Health Information received from, or created or received on behalf of, the Covered Entity available to the Secretary of HHS upon request for purposes of determining the Covered Entity’s compliance with HIPAA, the Privacy Rule, the Electronic Transactions Rule, and the HITECH Act, as applicable.
