Audits - SBC SNET only. 11.2.1 Except as provided in Appendix Compensation, SBC SNET shall arrange for one (1) annual independent audit to be conducted by a “Big Six” independent public accounting firm or an accounting firm mutually agreed to by SBC SNET, CLEC and all other CLECs doing business with SBC SNET under the terms of an agreement adopted pursuant to Sections 251 and 252 of the Act for the purpose of evaluating the accuracy of SBC SNET’s billing and invoicing.
11.2.2 SBC SNET will cooperate fully with the independent auditor in such audit and provide reasonable access to any and all appropriate SBC SNET employees, books, records and other documents reasonably necessary to perform the audit.
11.2.3 SBC SNET shall promptly correct any billing error that is revealed in the audit, including making refund of any overpayment to CLEC in the form of a credit on the invoice for the first full billing cycle after the audit report is issued; such refund shall include interest on the overpayment at the rate of eight percent (8%) per year. In the event that the audit reveals any underbilling and resulting underpayment to SBC SNET by CLEC, the underpayment shall be reflected in CLEC’s invoice for the first full billing cycle after the audit report is issued. SBC SNET will not be entitled to recover interest on any underbilling to CLEC revealed by the audit for the time preceding the amount appearing on XXXX'x xxxx from SBC SNET, however, SBC SNET shall be entitled to recover interest at the interest rate referenced in Section 8.1.5.1 on such underbilling and CLEC shall pay interest for the number of calendar days from the Xxxx Due Date of the xxxx on which such underbilling was rectified until the date on which payment is made and available to SBC SNET.
