Authority Property. 29.1 Where the Authority for the purpose of the Agreement issues Authority Property free of charge to the Supplier such property shall be and remain the property of the Authority. The Supplier shall not in any circumstances have a lien on the Authority Property and the Supplier shall take all reasonable steps to ensure that the title of the Authority to such Authority Property and the exclusion of any such lien are brought to the notice of all Sub-Contractors and other persons dealing with the Agreement.
29.2 Any Authority Property made available or otherwise received by the Supplier shall be deemed to be in good condition when received by or on behalf of the Supplier unless the Supplier notifies the Authority otherwise within 5 Working Days of receipt.
29.3 The Supplier shall maintain all Authority Property in good order and condition, excluding fair wear and tear, and shall use Authority Property solely in connection with the Agreement and for no other purpose without prior Approval.
29.4 The Supplier shall ensure the security of all Authority Property, whilst in the Supplier’s possession, either on its premises or elsewhere during the performance of the Agreement, in accordance with the Authority’s reasonable security requirements as required from time to time.
29.5 The Supplier shall be liable for any and all Loss of or damage (excluding fair wear and tear) to any Authority Property, unless the Supplier is able to demonstrate that such loss or damage was caused by the negligence or default of the Authority. The Supplier’s liability set out in this clause shall be reduced to the extent that such Loss or damage was contributed to by the negligence or default of the Authority. The Supplier shall inform the Authorised Officer within 2 Working Days of becoming aware of any defects appearing in or losses or damage occurring to Authority Property made available for the purposes of the Agreement.

20.4. The Contractor shall notify the Contract Manager of any surplus Authority Property remaining after the expiry, termination and/or partial termination (as appropriate) of the Agreement and shall dispose of it as the Authority may direct. Waste of such Authority Property arising from bad workmanship or negligence of the Contractor or any of the Contractor’s employees, servants, agents, suppliers or sub-contractors shall be made good at the Contractor’s expense. Without prejudice to any other rights of the Authority, the Contractor shall deliver up Authority Property whether processed or not to the Authority on demand.
20.5. The Contractor shall ensure the security of all Authority Property, whilst in the Contractor’s possession, either on its premises or elsewhere during the performance of the Agreement, in accordance with the Authority’s reasonable security requirements as required from time to time.
20.6. Authority Property. The Supplier acknowledges that all materials, equipment and tools, drawings, specifications, and data supplied by the Authority to the Supplier (“Authority Materials”) and all rights in the Authority material are and shall remain the exclusive property of the Authority. The Supplier shall keep the Authority Materials in safe custody at its own risk, maintain them in good condition until returned to the Authority, and not dispose or use the same other than in accordance with the Authority's written instructions or authorisation.
Authority Property. On the activation date, the Authority accepts the water service(s) from the water main to the curb stop for ownership and operation and, from that date, the service(s) shall be and remain the property of the Authority, its successors and assigns.
Authority Property. On the completion date, the Authority accepts the water main extension for ownership and operation and, from that date, the extension shall be and remain the property of the Authority, its successors and assigns. The Authority shall have the absolute right to extend the water main extension in or to other public or private lands without limitation and without notice to the Developer or incurring any obligation to the Developer whatsoever.
Authority Property. The provisions of this Section shall not be construed (a) to create any recourse on the part of the Creditors against the Tribe, its Properties or revenues except for any breach of the Tribe's own representations, warranties and covenants set forth in Articles 4 and 9, or (b) to require exhaustion by the Creditors of any remedies against Borrower or the Authority Property prior to having recourse, in the proper case, against the Tribe and Non-Authority Property.
Authority Property i. Employee will do everything necessary for the proper safeguarding of Employer’s property / equipment entrusted to employee for operation/use. Any negligence on employee’s part in such upkeep or any loss taking place as a result, will not only entail recovery of the value of the loss from payments due to employee, but will also be deemed sufficient ground for termination of this agreement. Any
ii. Any employer property entrusted to employee for employee’s personal use during employee’s association with the employer must be returned to the employer, after use, in good repair, normal wear and tear exempted. In case the employer had deteriorated, while in employee’s custody, due to negligence on employee’s part, the employer reserves the right to recover from employee the cost of repairing and restoring it.
Authority Property. Where the Authority issues Authority Property free of charge to the Supplier such Authority Property shall be and remain the property of the Authority and the Supplier irrevocably licences the Authority and its agents to enter upon any premises of the Supplier during normal business hours on reasonable notice to recover any such Authority Property.

11.2 The Contractor will be liable for any loss of or damage to any Authority Property unless The Contractor is able to demonstrate that such loss or damage was caused or contributed to by the act, neglect or default of the Authority. The Contractor will maintain all items of Authority Property in good and serviceable condition, fair wear and tear excepted and in accordance with the manufacturers recommendations.

24.4 The Contractor shall ensure the security of all Authority Property whilst in the Contractor’s possession (either on its premises or elsewhere) during the performance of the Agreement, in accordance with the Authority’s reasonable security requirements as required from time to time.
24.5 The Contractor shall be liable for any and all loss of or damage (excluding fair wear and tear) to any Authority Property, unless the Contractor is able to demonstrate that such loss or damage was caused by the negligence or default of the Authority. The Contractor’s liability set out in this Clause 24 shall be reduced to the extent that such loss or damage was contributed to by the negligence or default of the Authority. The Contractor shall inform the Contract Manager within two (2) Working Days of becoming aware of any defects appearing in or losses of or damage occurring to Authority Property.
