Common use of Authority to Deduct Clause in Contracts

Authority to Deduct. If in the event that the employee receives excess payment or monies to which the employee is not entitled, the employee hereby authorises the employer to make all necessary deductions from the employee’s pay to correct the situation. This provision will apply as soon as the discovery of the error or overpayment is made. If a provision of the Act, a Regulation made under the Act, or a decision of a competent authority results in the employee being deemed to be a Full Time or a Part Time employee and, as a result the employee has been paid the Casual Loading during a period when they were deemed not to be a Casual employee, then the overpayment of that Casual Loading may be recovered from any entitlements that arise from the employee being deemed to be a Full Time or a Part Time employee.
