Authority to Enter Project Agreement. By signing this Agreement, EPA, PSNS, and WDOE acknowledge and agree that they have the respective authorities, discretion, and resources to enter into this Agreement and to implement all of the applicable provisions of this Project. Nothing in this agreement shall be construed as obligating any of the parties, their officers, employees, or agents to expend any funds in excess of appropriations authorized for such purposes in violation of the federal Anti-Deficiency Act (31 U.S.C. Section 1341). The parties understand that any obligation of appropriated funds under this Agreement and all future Addenda is subject to the availability of appropriated funds in accordance with the requirements of the Anti-Deficiency Act, 31 U.S.C. Section 1341. If appropriated funds are not available to fulfill the obligation of the U.S. Navy or the EPA under this Agreement, the parties shall agree to an appropriate adjustment of the time-schedule or proposal, or the proposal shall be withdrawn.

  • Authority to Bind Parties Neither party in the performance of any and all duties under this Agreement, except as otherwise provided in this Agreement, has any authority to bind the other to any agreements or undertakings.
