Common use of Authority's Representative Clause in Contracts

Authority's Representative. The Authority shall appoint a duly authorised representative ("Authority's Representative") to act on its behalf under this Contract. The Authority’s Representative shall be such person whose name, address, contact number and designation have been provided in Schedule 5 (Authority’s Representative). The Authority’s Representative shall carry out the duties assigned to them, and shall exercise the authority delegated to them, by the Authority. Unless and until the Authority notifies the Contractor otherwise by written notice, the Authority's Representative shall be deemed to have the full authority of the Authority under this Contract, except in respect of Clause 16.1 (Termination by Authority). If the Authority wishes to replace any person appointed as Authority's Representative, the Authority shall, within 2 (two) days of such replacement, give the Contractor notice of the replacement's name, address, duties and authority, and of the date of appointment. However, it is acknowledged by the Contractor that any action, omission or failure to take action on part of the Authority’s Representative under this Clause 7.3 shall not in any way relieve the Contractor from its obligations under this Contract. 7.3.1 The Authority at its own cost and expense, has appointed appoint a Design and Technical Agency (“DTA”) to be the independent consultant under this Contract to monitor the Project during the Construction Period. The DTA shall discharge its duties and functions substantially in accordance with Article 13 and the terms of reference set forth in Schedule 9. 7.3.2 The Authority may also engage or appoint its engineer(s) or its official(s) to observer and monitor the Project during the Term of the Contract.
