Authorization of Expenditure and Appropriation of Funds. The City hereby authorizes the expenditure of Five Hundred Thousand and Two 00/100 Dollars ($500,000.00) of the RLF to the Authority for the purposes of providing assistance to businesses physically located in the City of Norfolk facing sudden and severe economic dislocation caused by the COVID-19 and provide permanent resources to support economic resiliency. Further, the City hereby authorizes the expenditure of Forty-Nine Thousand Nine Hundred and 00/100 Dollars ($49,900.00) to the Authority to defray the cost of administering the RLF.

Authorization of Expenditure and Appropriation of Funds. The City hereby appropriates and authorizes the expenditure of Three Hundred Eighty Thousand and 00/100 Dollars ($380,000.00) for the purpose of allowing the EDA to enter into the Grant Agreement attached hereto as Exhibit A and to make the grant payments provided for and in accordance with the Grant Agreement.
Authorization of Expenditure and Appropriation of Funds. The City hereby appropriates and authorizes the expenditure of Two Million and 00/100 Dollars ($2,000,000.00) of the CARES Act Funds to the Authority for the purpose of allowing the Authority to provide grants to small for-profit businesses and nonprofit businesses physically located in the City of Norfolk and affected by COVID-19 (the “CARES Fund Grants”). The Authority shall be permitted to use up to Fifty Thousand and 00/100 Dollars ($50,000 of the CARES Act Funds transferred hereunder for additional costs incurred by the Authority to administer the CARES Fund Grants.

  • Annual Appropriation of Funds Contractor acknowledges that the Contract term may extend over multiple City fiscal years, and that work and compensation under this Contract is contingent on the City Council appropriating funding for and authorizing such work and compensation for those fiscal years. This Contract may be terminated at the end of the fiscal year for which sufficient funding is not appropriated and authorized. City is not obligated to pay Contractor for any amounts not duly appropriated and authorized by City Council.

  • Authorization of appropriations There are authorized to be appropriated such sums as are necessary to carry out this section.

  • Certification of Funds; Budget and Fiscal Provisions; Termination in the Event of Non-Appropriation This Agreement is subject to the budget and fiscal provisions of the City’s Charter. Charges will accrue only after prior written authorization certified by the Controller, and the amount of City’s obligation hereunder shall not at any time exceed the amount certified for the purpose and period stated in such advance authorization. If funds are appropriated for a portion of the fiscal year, this Agreement will terminate, without penalty, liability or expense of any kind at the end of the term for which funds are appropriated. City has no obligation to make appropriations for this Agreement in lieu of appropriations for new or other agreements. City budget decisions are subject to the discretion of the Mayor and the Board of Supervisors. Contractor’s assumption of risk of possible non-appropriation is part of the consideration for this Agreement. THIS SECTION CONTROLS AGAINST ANY AND ALL OTHER PROVISIONS OF THIS AGREEMENT.

  • Authorization and Application of Overtime (a) An employee who is required to work overtime shall be entitled to overtime compensation when:

The Parties agree that the failure of Respondent to comply with any term or condition of this Agreement with respect to a particular State shall be treated as a violation of an Order of the State and may be enforced as such. Moreover, Respondent acknowledges and agrees that this Agreement is only binding on the State Mortgage Regulators and not any other Local, State or Federal Agency, Department or Office.

  • Authorization of Agreement This Agreement has been duly authorized, executed and delivered by the Company.

  • Termination for Non-Appropriation of Funds Notwithstanding any other provision of this Contract, the County shall not be obligated for the Contractor’s performance hereunder or by any provision of this Contract during any of the County’s future fiscal years unless and until the County’s Board of Supervisors appropriates funds for this Contract in the County’s Budget for each such future fiscal year. In the event that funds are not appropriated for this Contract, then this Contract shall terminate as of June 30 of the last fiscal year for which funds were appropriated. The County shall notify the Contractor in writing of any such non-allocation of funds at the earliest possible date.

  • Non-Appropriation of Funds This Contract is contingent upon the appropriation of sufficient funds by appropriate MPS officials. If funds are not appropriated, Contractor agrees to take back any commodities furnished under the Contract, terminate any services supplied to MPS under the Contract, and relieve MPS of any further obligations under the Contract.

  • Fiscal Appropriations This Contract is subject to and contingent upon available local, state, and/or federal funds and applicable budgetary appropriations being approved by the County of Orange Board of Supervisors for each fiscal year during the term of this Contract. If such appropriations are not approved, the Contract will be terminated, without penalty to the County.
