Availability and Authorized Absence Clause Samples
The Availability and Authorized Absence clause defines the expectations for when an individual, such as an employee or contractor, must be present and available to perform their duties, as well as the conditions under which they may be absent with permission. Typically, this clause outlines standard working hours, procedures for requesting leave, and the types of absences that are considered authorized, such as vacation, illness, or personal emergencies. Its core function is to ensure operational continuity by clarifying attendance requirements and providing a structured process for managing absences.
Availability and Authorized Absence. (a) Members not on leave are required to be present on campus when their presence is required for assigned teaching duties or scheduled consultation with or guidance of students, including a reasonable number of regularly scheduled office hours, and when the ▇▇▇▇ gives them reasonable notice that, for good and valid reason, their presence on campus is required. Members not on leave who have assigned teaching duties require the authorization of the ▇▇▇▇ prior to any absence.
(b) Members are not required to be present on campus to fulfill their workload obligations whenever another location is more appropriate for that purpose and absence from campus does not conflict with obligations under Article 24.10(a). However, each Member who is not on leave will ensure that the ▇▇▇▇ is aware of how and where the Member can be contacted without undue delay in case, for good and valid reason, the Member's presence on campus is required, in which event the Member will return to campus, also without undue delay.
(c) Notwithstanding the foregoing, a Member may request and the ▇▇▇▇ may grant an authorized absence of up to sixty (60) calendar days during which Member is not subject to being recalled to the campus, provided that during the period of authorized absence the Member has no scheduled teaching or academic service activities. The ▇▇▇▇ will decide within fifteen (15) working days of the request, and the ▇▇▇▇ will not unreasonably deny a request for authorized absence. While an authorized absence can be renewed, a continuous period of authorized absence should not normally exceed one hundred and twenty (120) calendar days.
(d) A period of authorized absence is not a leave, and the Member is presumed to be at work by engaging in scholarly, creative, or professional activities, participating in conferences or the like, performing services for the academic community, or preparing for scheduled duties.

(b) Members are not required to be present on campus to fulfill their workload obligations whenever another location is more appropriate for that purpose and absence from campus does not conflict with obligations under 35.13(a). However, each Member who is not on leave will ensure that the ▇▇▇▇ is aware of how and where the Member can be contacted without undue delay in case, for good and valid reason, the Member's presence on campus is required, in which event the Member will return to campus, also without undue delay.
