Common use of Availability and Authorized Absence Clause in Contracts

Availability and Authorized Absence. (a) Members not on leave are required to be present on campus when their presence is required for assigned teaching duties or scheduled consultation with or guidance of students, including a reasonable number of regularly scheduled office hours, and when the Xxxx gives them reasonable notice that, for good and valid reason, their presence on campus is required. Members not on leave who have assigned teaching duties require the authorization of the Xxxx prior to any absence. (b) Members are not required to be present on campus to fulfill their workload obligations whenever another location is more appropriate for that purpose and absence from campus does not conflict with obligations under Article 24.10(a). However, each Member who is not on leave will ensure that the Xxxx is aware of how and where the Member can be contacted without undue delay in case, for good and valid reason, the Member's presence on campus is required, in which event the Member will return to campus, also without undue delay. (c) Notwithstanding the foregoing, a Member may request and the Xxxx may grant an authorized absence of up to sixty (60) calendar days during which Member is not subject to being recalled to the campus, provided that during the period of authorized absence the Member has no scheduled teaching or academic service activities. The Xxxx will decide within fifteen (15) working days of the request, and the Xxxx will not unreasonably deny a request for authorized absence. While an authorized absence can be renewed, a continuous period of authorized absence should not normally exceed one hundred and twenty (120) calendar days. (d) A period of authorized absence is not a leave, and the Member is presumed to be at work by engaging in scholarly, creative, or professional activities, participating in conferences or the like, performing services for the academic community, or preparing for scheduled duties.
