AVAILABILITY REPORT. The term “Availability Report” shall mean a report executed by the Borrower in the form of Exhibit B to this Agreement.
AVAILABILITY REPORT. Contains Software Availability statistics (e.g., number and duration of Critical Incidents, Emergency Maintenance occurrences and Scheduled Downtimes).
AVAILABILITY REPORT. Written communication from CHORISTER to EMPLOYER indicating the Productions in an upcoming Season for which the CHORISTER is available.
AVAILABILITY REPORT. Lender shall have received an Availability Report with respect thereto from Borrower (or Servicer on behalf of Borrower) executed by an authorized representative of Borrower or Servicer and all supporting documentation as Lender may request;
AVAILABILITY REPORT. Beginning January 1999, and for each subsequent Month during the term of this Agreement, UPR and UPFUELS shall jointly develop an Availability Report (the "Availability Report") setting forth the Parties' best estimate of the quantity, type of Purity Products and/or Components of Subject NGLs that UPR will deliver to UPFUELS from each plant and at each Delivery Point during the following Month. The Availability Report shall be completed by the 25th Day of the Month prior to the Month during which such Subject NGLs are to be delivered. The Monthly Availability Report shall be on a Component-by- Component basis, and shall be deemed available for ratable delivery throughout the Month. If the Parties cannot agree on an Availability Report by the 25th Day of such Month, then the forecast for the relevant Month shall be the actual deliveries of NGLs (by location and Component) for the immediately preceding Month. The Parties shall use commercially reasonable efforts to keep each other informed of significant Daily variations in the quantities of Subject NGLs available for purchase and sale hereunder.

  • Borrowing Base Report The Agent shall have received from the Borrower the initial Borrowing Base Report dated as of the Closing Date.

  • Borrowing Base Reports Within thirty (30) days after the last day of each month, aged listings of accounts receivable and accounts payable (by invoice date) (the “Borrowing Base Reports”);

  • RDDS availability Refers to the ability of all the RDDS services for the TLD, to respond to queries from an Internet user with appropriate data from the relevant Registry System. If 51% or more of the RDDS testing probes see any of the RDDS services as unavailable during a given time, the RDDS will be considered unavailable.

  • Borrowing Base Certificate The Administrative Agent shall have received a completed Borrowing Base Certificate duly executed by a financial officer of the Borrower, setting forth the calculation of the initial Borrowing Base as of the last day of the month preceding the date of the initial Advance under the Revolving Facility or the initial Letter of Credit.

  • System Availability Although we will try to provide continuous access to the Service, we cannot and do not guarantee that the Service will be available 100% of the time and will not be liable in the event Service is unavailable. Actual service or network performance is dependent on a variety of factors outside of our control. If you notify us within twenty-four (24) hours and we confirm an outage consisting of a period of two (2) hours in any calendar month, and not due to any service, act, or omission of you, a third party, your applications, equipment or facilities, or reasons outside of our control, you shall be eligible for a service credit. A service credit shall be computed as a pro-rated charge for one day of the regular monthly fees for the Service in the next monthly statement. Intermittent service outages for periods of less than two (2) hours are not considered service outages. Outages caused by routine scheduled maintenance are also not considered an outage. You shall receive advance notice no less than forty-eight (48) hours in advance of our scheduled maintenance. Scheduled maintenance will be performed between 12:00 a.m. and 6:00 a.m. CST.
