AWARD PROCEDURE. 1.1 If the Authority or any Other Contracting Body decides to source the Goods and Services through the Framework then it will award its Goods and Services Requirements in accordance with the procedure in this Framework Schedule 5 (Ordering Procedure) and the requirements of the Regulations and the Guidance. 1.2 If a Contracting Body can determine that: 1.2.1 its Goods and Services Requirements can be met by the Framework Supplier's Catalogue as set out in Framework Schedule 1 (Goods and Services); 1.2.2 the Framework Supplier provides the most economically advantageous solution in respect of the Contracting Body’s Goods and Services Requirements; and 1.2.3 all of the terms of the proposed contract are laid down in this Framework Agreement and the Call Off Terms do not require amendment or any supplementary terms and conditions; then the Contracting Body may place an Order in accordance with the Direct Ordering Procedure set out in paragraph 1.4 below. 1.3 If all of the terms of the proposed contract are not laid down in this Framework Agreement and/or if the Goods and Services required are listed in Lots 11 or 12 and a Contracting Body 1.3.1 requires the Supplier to develop proposals or a solution in respect of such Contracting Body’s Goods and Services Requirements; and/or 1.3.2 needs to amend or refine the Call-Off Terms to reflect its Goods and Services Requirements to the extent permitted by and in accordance with the Regulations and Guidance; then the Contracting Body shall place an Order in accordance with the procedures set out in Paragraph 3 below. 1.4 The Supplier shall not accept Orders for Goods Services under Lots 1 to 10 (inclusive) where the Contracting Body seeks to operate a further competition procedure under paragraph 3 of this Schedule 5 unless the prior written consent of the Authority (which shall not be unreasonably refused) has been obtained.

AWARD PROCEDURE. 1.1 If the Authority or any Other Contracting Body decides to source the Goods and Services through the Framework Agreement then it will award its Goods and Services Requirements in accordance with the procedure in this Framework Schedule 5 3 (Ordering Procedure) and the requirements of the Regulations and the Guidance. 1.2 If a Contracting Body can determine that: 1.2.1 its Goods and Services Requirements can be met by the Framework Supplier's Catalogue catalogue of Services as set out in Framework Schedule 1 (Goods and Services)the Supplier’s description of Services on the Government Procurement Service website; 1.2.2 the Framework Supplier provides the most economically advantageous solution in respect of the Contracting Body’s Goods and Services Requirements; and 1.2.3 all of the terms of the proposed contract are laid down in this Framework Agreement and the Call Off Terms do not require amendment or any supplementary terms and conditions; then the Contracting Body may place an Order in accordance with the Direct Ordering Procedure set out in paragraph 1.4 2 below. 1.3 If all of the terms of the proposed contract are not laid down in this Framework Agreement and/or if the Goods and Services required are listed in Lots 11 or 12 and a Contracting Body: 1.3.1 requires the Supplier to develop proposals or a solution in respect of such Contracting Body’s Goods and Services Requirements; and/or 1.3.2 wants to invite the Supplier to propose a Charging Structure which is more beneficial (compared to that set out in this Framework Agreement) to the Contracting Body; and/or 1.3.3 needs to amend or refine the Call-Off Terms to reflect its Goods and Services Requirements to the extent permitted by and in accordance with the Regulations and Guidance; then the Contracting Body shall place an Order in accordance with the procedures set out in Paragraph 3 below. 1.4 The Contracting Bodies shall be entitled to share information relating to further competitions run by Contracting Bodies pursuant to this Framework Agreement and Orders that it places with the Supplier shall and pricing information (which includes information on prices tendered in a further competition, even where an Order is not accept Orders for Goods Services under Lots 1 to 10 (inclusiveplaced) where and the terms of any Call-Off Agreement, with any Crown Body or any other Contracting Body seeks from time to operate a further competition procedure under paragraph 3 time, subject always to the provisions of this Schedule 5 unless the prior written consent of the Authority Clause 17 (which shall not be unreasonably refused) has been obtainedConfidentiality).
