The preliminary schedule is attached hereto as Exhibit B. During the Preconstruction Phase, the Construction Manager shall monitor the Project’s progress and promptly notify the Department of any delays, regardless of their cause, the causes of such delays, and the Construction Manager’s best projection of the effect of such delays on the Project Schedule. The Department's receipt of, and lack of objection to, any schedule update showing a later Substantial Completion or Final Completion shall not be regarded as the Department’s agreement that the Construction Manager may have an extension of time, or as a waiver of any of the Department’s rights, but merely as the Construction Manager’s representation that, as a matter of fact, the Project may not be completed by the applicable Substantial or Final Completion Date. The Project Schedule shall be maintained and continuously updated during the Preconstruction and Construction Phases.
