Common use of Basis of Bargain Clause in Contracts

Basis of Bargain. You recognize and agree that the warranty disclaimers and liability and remedy limitations in this Agreement, including without limitation in this Limited Warranty Section have been bargained for and form the basis of this Agreement and that they have been taken into account and reflected in determining the consideration to be given by You under the respective Purchase Order and in the decision to enter into this Agreement.
