Common use of Basket Limitation Clause in Contracts

Basket Limitation. Neither Party shall be entitled to make any claim under this Paragraph until such time as all such claims by the Party exceed [agreed amount] in the aggregate, or until such claim, if not made, would be barred by the statute of limitation, at which time all such claims of that party may be made. When aggregated claims in excess of [agreed amount] have been made, the same rule shall apply with respect to future claims.
