Common use of Before or After Substantial Completion Clause in Contracts

Before or After Substantial Completion. (1) The Contractor shall promptly correct Work rejected by the Project Manager and/or Architect/Engineer for failing to conform to the requirements of the Contract Documents, whether discovered before or after Substantial Completion and whether or not fabricated, installed or completed. Costs of correcting such rejected Work, including additional testing and inspections and compensation for the Architect/Engineer's services and expenses made necessary thereby, shall be at the Contractor's expense.

Costs of correcting such rejected Work, including additional testing and inspections inspections, the cost of uncovering and replacement, compensation for any design consultant employed by the Owner whose expenses and compensation for the Architect/Engineer's services and expenses were made necessary thereby, and the Owner’s attorneys’ fees and related costs, disbursements, all of which shall be at the Contractor's ’s expense.
