Beneficiary Rights. If the PHP fails to abide by the terms of this participation agreement and TMA or its designee either denies the claim or claims and/or terminates the agreement as a result, the PHP agrees to forego its rights, if any, to pursue the amounts not paid by TRICARE/ CHAMPUS from the beneficiary or the beneficiary’s family.
