Common use of Bidding Rights Upon Return to Former Position Clause in Contracts

Bidding Rights Upon Return to Former Position. ‌ An employee who transfers or promotes and subsequently exercises the option to return to their former position before completing probation, or who is returned to their former position during probation, will be eligible to bid six months from the date of their return. An employee who is bumped by another employee returning to their original position will be eligible to bid immediately. This provision may be waived upon mutual agreement of all parties. In the event the employee returns to their previous position the employee’s probationary status at the time of the bid shall resume.
