Binding Commitment. Upon conclusion of the Match and SOAP, programs:
1. Are in a binding commitment with the applicant and must offer an appointment as matched or offered:
a. Programs who encourage an applicant with a Match or SOAP commitment to seek a concurrent year position, absent a waiver or deferral from the NRMP, shall be presumed to have violated this Agreement.
2. Must begin training applicants on the start date specified in the appointment contract with the intent to complete the applicant’s training:
a. The binding commitment will be deemed to have been honored by the applicant so long as the applicant enters and remains in the training program through the first 45 calendar days after the start date of the relevant appointment contract.
b. The binding commitment exists through the first 45 calendar days of the start date of the relevant appointment contract.
c. Programs terminating a resident within 45 days of the start date specified in the appointment agreement, without having an approved waiver or deferral from the NRMP, will be in violation of this Agreement.
d. Applicants who give notice of resignation, resign, or vacate a position within 45 days of the start date specified in the appointment agreement, without having an approved waiver or deferral from the NRMP, will be in violation of this Agreement. Programs must report such violations to xxxxxx@xxxx.xxx. Each appointment is subject to the official policies of the appointing institution and program in effect on the Rank Order List Certification Deadline or when the program submits its preference list if the program participates in SOAP.
1. Programs must adhere to the disclosure policies regarding accuracy, completeness, and timeliness of Information as outlined in Section 6.2 of this Agreement.
2. Programs who fail to disclose the official policies of the appointing institution and/or program, as outlined in Section 6.2 of this Agreement, prior to the Rank Order List Certification Deadline, or during SOAP, may not be eligible to receive a waiver or deferral of the matched appointment.
Binding Commitment. Acceptance of the Terms and Conditions of this Agreement constitutes a binding commitment by the Resident for the full term as outlined in Section 2.0 of this Agreement.

Binding Commitment. Subject to the satisfaction of the conditions in Section 5 of the Bond Sale Agreement, the Bond Sale Agreement shall constitute a binding commitment of the Locality to sell its local school bond to VPSA as of the later of the VPSA Sale Date and the date the Local Issuer executes the Bond Sale Agreement.

a. The binding commitment will be deemed to have been honored by the applicant so long as the applicant enters and remains in the training program through the first 45 calendar days after the start date of the relevant appointment contract.
b. The binding commitment exists through the first 45 calendar days of the start date of the relevant appointment contract.
c. Programs terminating a resident within 45 days of the start date specified in the appointment agreement, without having an approved waiver or deferral from the NRMP, will be in violation of the applicable Agreement.
d. Binding Commitment. This Agreement constitutes a legal, valid and binding obligation of the PURCHASER. The PURCHASER has full power, right and authority to enter into and perform this Agreement. The execution and delivery and performance of this Agreement will not violate or be in conflict with any order, judgment, injunction, agreement or controlling document to which the PURCHASER is a party or by which it is bound. If the PURCHASER is an entity, it was not formed for the specific purpose of acquiring the Debenture.
Binding Commitment. Once a Vacant Fellowship Position is offered and accepted, it becomes a binding commitment, subject to the satisfactory completion of the Minimum Fellowship Eligibility Criteria, along with any Specialty Eligibility Criteria set by the Fellowship Program. Once such an offer is made and accepted, a copy or notice of the acceptance or agreement (whether formal or informal) must be sent to the Match Committee within one week of the acceptance or agreement. Failure to honor a commitment made to a Vacant Fellowship Position, unless a Waiver is obtained, may subject the violating Fellowship Program or the Fellowship Candidate to the same sanctions applicable to a Fellowship Program and Fellowship Candidate who Match on the basis of Rank List submission and the subsequent SF Match algorithm, pursuant to Section 8.0.
Binding Commitment. The [ * ] of each Order Forecast shall constitute a binding commitment for Licensee to purchase, pursuant to Section 2.3(a), [ * ] of the quantities for each form of Finished Product specified therein and Licensee shall be required to order such quantities pursuant to Section 2.3(a). The [ * ] of each Order Forecast shall constitute a binding commitment for Licensee to purchase, pursuant to Section 2.3(a), [ * ] of each form of Finished Product specified therein. For clarity, the numbers set out in the following [ * ] of the Order Forecast constitute the non-binding forecast of Licensee’s expected requirements.
Binding Commitment. Bank hereby acknowledges itself duly and firmly bound for the faithful performance of all the duties and obligations required by applicable law, including the Education Code, Government Code and Local Government Code, such that all funds deposited with it as depository shall be faithfully kept by it and accounted for according to law.
Binding Commitment. A MATCH IS A BINDING COMMITMENT ON BOTH THE FELLOWSHIP CANDIDATE AND THE FELLOWSHIP PROGRAM. FELLOWSHIP PROGRAMS AND FELLOWSHIP CANDIDATES ARE NOT AUTHORIZED TO RELEASE EACH OTHER FROM A MATCH; RATHER A RELEASE OF A MATCH MAY ONLY BE MADE BY THE MATCH COMMITTEE, PURSUANT TO THE WAIVER PROVISIONS OUTLINED IN THIS AGREEMENT. PARTICIPANTS UNDERSTAND THAT WAIVERS ARE NOT AUTOMATIC, AND ARE GRANTED IN ONLY RARE CIRCUMSTANCES.
