Binding Effect; Enforcement. This Agreement shall be and become binding upon, and inure to the benefit of, the Parties hereto, their heirs and personal representatives. This Agreement shall be construed and interpreted according to the laws of the State of Colorado, and any action necessary to enforce, construe, or interpret the within shall be maintained in the District Court in and for Xxxxxxx County, Colorado. Nothing in this Agreement shall prevent or preclude the Parties' mutual agreement to submit any dispute arising from this Agreement to mediation or arbitration.
Binding Effect; Enforcement. The parties agree and intend that (i) this Shareholder Agreement will be a valid and binding agreement, enforceable against the parties hereto according to its terms; (ii) damages and other remedies at law for the breach of this Agreement are inadequate; and (iii) Union shall be entitled to specific performance of the obligations of the Shareholders and CSBT hereunder.

Binding Effect; Enforcement. This Restrictive Covenant and the restrictions, covenants, benefits and obligations created hereby are benefits and servitudes running with the Property and are binding on future owners of all or any portion of the Property. However, the benefits hereunder (and the right to enforce this Restrictive Covenant) inure solely to the benefit of NWACA and are not assignable. This Restrictive Covenant may be enforced by NWACA by action at law or in equity, including, without limitation, action for specific performance or injunctive relief. In no event shall Declarant be liable for punitive or consequential damages resulting from any violation or breach of this Restrictive Covenant.
Binding Effect; Enforcement. The covenants set forth herein shall run with the land and shall be binding upon the Parties. In the event of arbitration or litigation regarding the terms hereof, the prevailing party shall be entitled to recover its attorneys’ fees and costs. This Agreement shall be governed by the laws of the State of Colorado. Any litigation shall be in the Garfield County, Colorado District Court.
