Common use of Bona Fide Firm Order Clause in Contracts

Bona Fide Firm Order. 6.12.1 In Alabama, North Carolina, and Tennessee, DSLi shall indicate its intent to proceed with equipment installation in a BellSouth Premises by submitting a Physical Expanded Interconnection Firm Order document (“Firm Order”) to BellSouth. A Firm Order shall be considered Bona Fide when DSLi has completed the Application/Inquiry process described in Section 6, preceeding, and has submitted the Firm Order document indicating acceptance of the Application Response provided by BellSouth. A BellSouth response to a Bona Fide Firm Order will include a Firm Order Confirmation containing the firm order date. No revisions will be made to a Bona Fide Firm Order.

The Bona Fide Firm Order must be received by BellSouth no later than thirty (30) calendar days (in Mississippi 30 business days) after BellSouth’s Application Response to ALEC Inc.,’s Bona Fide Application or the Application will expire. 6.12.4 BellSouth will establish a firm order date based upon the date BellSouth is in receipt of a Bona Fide Firm Order. BellSouth will acknowledge the receipt of DSLiALEC Inc.,’s Bona Fide Firm Order within seven (7) calendar days of receipt indicating that the Bona Fide Firm Order has been received. A Firm Order shall be considered Bona Fide when DSLi T-Mobile has completed the Application/Inquiry process described in Section 6, preceeding, and has submitted the Firm Order document indicating acceptance of the Application Response provided by BellSouth. The Bona Fide Firm Order must be received by BellSouth no later than five (5) business days after T-Mobile’s receipt of BellSouth’s Application Response to DSLiT-Mobile’s Bona Fide Applicationapplication in order to receive the intervals set forth in Section 7. The Bona Fide Firm Order must be received by BellSouth no later than thirty (30) calendar days after BellSouth’s Application Response to T-Mobile’s Bona Fide application or the application will expire. If the BFFO is received between the fifth business day and the thirtieth calendar day after the Application Response, then the intervals set forth in Section 7.1 will be extended day for day for each day after the fifth business day the Bona Fide Firm Order is received until the application expires. 6.12.2 Except as otherwise provided, in all States that have ordered provisioning intervals but not addressed Firm Order intervals, the following shall apply. DSLi T-Mobile shall indicate its intent to proceed with equipment installation in a BellSouth Premises by submitting a Firm Order to BellSouth. A Bona Fide Firm Order shall be considered Bona Fide when DSLi has completed requires ALEC, Inc. to complete the Application/Inquiry process described in Section 6Subsection 4.1, preceedingpreceding, submit an updated Application document that is substantially and materially identical to the initial Application/Inquiry document and is complete and accurate based on the outcome of the Application/Inquiry process, and has submitted the Firm Order document indicating acceptance of the Application Response provided by BellSouth. The Bona Fide Firm Order must be received by BellSouth no later than five (pay all applicable fees referenced in Article 5) business days after BellSouth’s Application Response to DSLi’s Bona Fide Application. 6.12.2 Except as otherwise provided, in all States that have ordered provisioning intervals but not addressed Firm Order intervals, the following shall apply. DSLi shall indicate its intent to proceed with equipment installation in a BellSouth Premises by submitting a Firm Order to BellSouthfollowing. The Bona Fide Firm Order must be received by BellSouth no later than thirty (30) calendar days after BellSouth’s Application Response response to DSLiALEC, Inc.’s Application/Inquiry. If ALEC, Inc. makes significant changes from the Application/Inquiry to space, power, or wiring requirements or changes in the amount or type of equipment to be placed, BellSouth will be required to re-evaluate and re-respond to the request. In the event BellSouth is required to re-evaluate and re-respond to the request, BellSouth’s provisioning interval will not start until the re-evaluation and response is complete and the Bona Fide Application or the Application will expire. Version 3Q01: 10/22/01Firm Order is accepted by BellSouth. 6.12.3 4.2.1 BellSouth will establish a firm order date date, per request, based upon the date BellSouth is in receipt of a Bona Fide Firm Ordercomplete and accurate firm order. BellSouth XxxxXxxxx will acknowledge the receipt of DSLiALEC, Inc.’s Bona Fide Firm Order within seven (7) calendar 15 days of receipt indicating that the Bona Fide Firm Order has been receivedreceived and that the order is accurate and complete or if the order is not accurate and complete, details as to the necessary information needed to cause the order to be accurate and complete. A BellSouth response to a Bona Fide Firm Order complete and accurate firm order will include a Firm Order Confirmation containing the firm order date. No revisions . 4.2.2 BellSouth will be made to a permit one site visit after receipt of the Bona Fide Firm Order. Security escort charges will be assessed for the site visit. 4.2.3 Space preparation for the Collocation Space will not begin until BellSouth receives the Bona Fide Firm Order and all applicable fees.
