Common use of Bona Fide Firm Order Clause in Contracts

Bona Fide Firm Order. In Alabama, North Carolina, and Tennessee, BTC shall indicate its intent to proceed with equipment installation in a BellSouth Premises by submitting a Physical Expanded Interconnection Firm Order document (“Firm Order”) to BellSouth. A Firm Order shall be considered Bona Fide when BTC has completed the Application/Inquiry process described in Section 6.2, preceding, and has submitted the Firm Order document indicating acceptance of the Application Response provided by BellSouth. The Bona Fide Firm Order must be received by BellSouth no later than seven (7) calendar days after BellSouth’s Application Response to BTC’s Bona Fide Application, unless BellSouth provides an Application Response on or before the ten-day response interval set forth in section 2.1, in which case BTC must submit its Bona Fide Firm Order to BellSouth within seventeen (17) calendar days of BellSouth’s receipt of the Bona Fide Application. If BTC fails to submit its Bona Fide Firm Order to BellSouth within the time frames set forth above, the provisioning intervals set forth in section 6.6 shall apply from the date of receipt of the Bona Fide Firm Order and not from the date of the Bona Fide Application.
