BOTTLER AFFILIATES Clause Samples

The 'Bottler Affiliates' clause defines which entities related to the bottler are included under the agreement’s terms. Typically, this clause clarifies that subsidiaries, parent companies, or other entities controlled by or under common control with the bottler are considered affiliates and may be subject to the same rights and obligations as the primary bottler. For example, if the bottler operates through multiple regional companies, those entities would also be covered. This clause ensures clarity about the scope of the agreement, preventing ambiguity about which related companies are bound by or benefit from its provisions.
BOTTLER AFFILIATES. Bottler hereby absolutely, unconditionally and irrevocably guarantees that any actions taken by any of Bottler’s Affiliates pursuant to this Agreement will be taken in accordance with all applicable requirements set forth herein to the same extent as if such actions had been taken by Bottler. Bottler acknowledges and agrees that any breach of this Agreement by any Affiliate of Bottler shall be considered a breach by Bottler for all purposes hereof.
