Common use of BREACH SANCTIONS Clause in Contracts

BREACH SANCTIONS. Each and every failure to comply with any of the provisions, covenants, or conditions of this Contract shall be a material breach of this Contract. In the event a breach occurs, the County's Contract Administrator may, in his sole discretion, and in addition to any other remedies available at law, in equity, or otherwise specified in this Contract: A. Afford the Contractor written notice of the breach and a ten-calendar day time period within which to cure the breach thereafter; B. Discontinue payment to the Contractor for and during the period in which the Contractor is in breach; and C. Offset against any monies billed by the Contractor but yet unpaid by the County, any and all damages incurred by County as a result of the breach.
